El Tribunal de Estrasburgo ha considerado, tras la denuncia de una madre española a la que España no permitía cambiar el orden de los apellidos de su hija, nacida en 2005, que la prevalencia del apellido paterno frente al de la madre es discriminatorio. Tras la entrada en vigor el pasado junio de 2017 de la reforma, la ley de Registro Civil hacía necesaria la autorización de ambos progenitores para poner el apellido de la madre primero, algo que no ocurría si el del padre iba primero.
En España, la situación cambió hace cuatro años, y en la época en la que la menor nació, la ley contemplaba que en caso de desacuerdo entre los padres, la joven llevaría primero el apellido paterno y luego el materno. De este modo la sentencia, recogida por Europa Press, recoge que el Estado español debe pagar 10.000 euros a la demandante «en concepto moral» y23.853 euros en costes.
«Si bien colocar el apellido paterno en primer lugar podría servir a los fines de la seguridad jurídica, el mismo propósito podría cumplirse al tener el apellido materno en este puesto. Por tanto, las razones dadas por el Gobierno no han sido suficientemente objetivas y razonables para justificar la diferencia de trato impuesta a la demandante», dice la sentencia.
En este sentido, en caso de que los progenitores no se pongan de acuerdo o cuando no se haya indicado el orden de los apellidos, el encargado del Registro Civil requerirá a los padres que lo comuniquen en tres días. Si esto no ocurre, el encargado acordará el orden de los apellidos atendiendo «al interior superior del menor», es decir, evitar las malsonancias al combinar el apellido con el nombre, por orden alfabético o sorteo, aclara el Tribunal.
